Paint Manufacturers' VOC Class Action Lawsuit Investigation
Investigating a potential class action lawsuit against four paint manufacturers who reached a settlement with the Federal Trade Commission on July 11, 2017 regarding misleading advertising on their paint products.

Affected manufacturers and product lines are as follows:
  • Benjamin Moore (Natura Paint)
  • ICP Construction (Muralo BreatheSafe Paint)
  • YOLO Colorhouse
  • Imperial Paints (Lullaby Paint)

All manufacturers claimed on packaging and advertisements that the specified product lines did not contain any harmful chemicals, substances, or volatile organic compounds (VOCs) though none had scientific data to corroborate their claims.  Furthermore, images of babies and pregnant women were used in advertisements to elicit consumer confidence about the safety of their paints. 

In addition, Benjamin Moore and ICP Construction affixed safety seals on their packaging that appear to be awarded from third party providers; however, each manufacturer created the seal (Benjamin Moore - Green Promise and ICP Construction - ECO Assurance) for their own marketing purposes.  If you have used any of these paints in a living area or residence, please contact us.
