Telephone Consumer Protection Act Class Action

 The Telephone Consumer Protection Act (TCPA) regulates the conduct of telephone solicitors and telemarketers. Under the TCPA it is illegal to call cell phones using an automatic dialer without prior express consent of the cell phone user.

When a debt collector uses an automatic dialing system to call cell phones to collect a debt the cell phones user may have a claim under both the TCPA and the Fair Debt Collection Practices Act.  The TCPA establishes a $500 statutory penalty per violation and up to $1,500 per violation if it is purposeful.
